FTC Cracks Down on Paid Endorsements & Testimonials

The Federal Trade Commission made an announcement this morning that will undoubtedly have a significant impact on bloggers. According the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising, writers of paid endorsements and testimonials will be required to disclose their connections to the seller of the product or services that they are supporting, or face fines up to $11,000. The Guides, which have not been revised since 1980, "add that new examples to illustrate the long standing principle that 'material connections' (sometimes payments or free products) between advertisers and endorsers - connections that consumers would not expect - must be disclosed. These examples address what constitutes an endorsement when the message is conveyed by bloggers or other 'word-of-mouth' marketers." Celebrity endorsements and social media postings are also subject to the new and improved guides.

This transparency will certainly be good for consumers, who have sensed for some time now that not all reviews are "real" and will definitely have an impact on advertising strategies. But it will interesting to see how the required disclosures will be presented - I'm guessing hidden and hard to distinguish, but we'll see.
